UAE gratuity and bank loan rules: can your bank take it?

Leaving a UAE job with a personal loan can affect your gratuity. Legal experts say banks may recover debts from it, but there are limits and ways to challenge deductions.

Workers in the UAE who leave a job while still repaying a personal loan may not get their full end-of-service payment straight away. The UAE gratuity bank loan rules mean a bank may freeze or use part of that money to recover the debt, but legal experts told Gulf News there are limits, and employees may be able to challenge deductions.

That matters if you are resigning, have lost your job, or are planning your final settlement. Your gratuity is not automatically off limits, but a bank also cannot take whatever it wants.

UAE gratuity bank loan rules: when a bank can use your payout

According to Gulf News, Ahmed Odeh, managing partner at MIO & Partners, said banks can generally use an employee's gratuity to settle an outstanding personal loan if the loan contract allows it and the bank follows UAE Central Bank rules.

He said many personal loan agreements require salary and end-of-service benefits to be paid into the lending bank. When a worker leaves a job, the bank may freeze the account receiving the gratuity as a precaution, even while it continues collecting instalments.

Odeh also said there is an important difference between holding gratuity as security and actually using it to repay the loan. If a borrower is still paying on time, that worker may have grounds to ask for the money to be released.

If you are preparing to leave a role, it is also worth checking your other final settlement items, such as unused annual leave and your experience certificate.

Limits on gratuity deductions in the UAE

A bank cannot automatically freeze your entire gratuity. Odeh said UAE Central Bank regulations stop banks from freezing more than the borrower actually owes.

He also said banks cannot freeze gratuity to repay a home loan. That is a key point for residents who have more than one banking commitment.

In many cases, the worker's consent is already part of the original loan agreement, so the bank may not need fresh approval before acting. But Odeh said no contract term can override the rules.

According to him, workers can:

  • ask the bank for a full loan statement
  • object if more money has been frozen than the amount owed
  • file a complaint with the bank
  • take the complaint to Sanadak, the UAE's independent banking complaints body, if the issue is not resolved
  • go to court if needed

What UAE Labour Law says about gratuity and deductions

Praise Olawanle, trainee solicitor at Stephenson Harwood Middle East LLP, told Gulf News that UAE Labour Law does not automatically give a bank the right to claim your gratuity. Any right the bank has comes from the loan agreement signed with the employee.

That means the wording of your loan contract matters. If the bank had no contractual basis, or if the loan was not yet due, Olawanle said the employee may be able to question the deduction and seek a refund.

She also pointed to Article 25 of the UAE Labour Law. This article allows deductions or withholding from wages only in specific cases, including repayment of loans advanced by the employer itself, with the employee's written consent, without interest, and within the allowed deduction limits.

Where more than one deduction applies, the total amount deducted or withheld cannot be more than 50 per cent of the employee's wage. Olawanle said these employment rules are separate from a bank's rights under a personal loan contract.

What workers and employers should do before final settlement

Olawanle said employers should be careful before transferring an employee's gratuity straight to a lender. Unless the employer has given the bank a specific written undertaking, it is not obliged to pay the gratuity to the lender, and doing so could lead to a complaint from the employee.

She added that Labour Law allows gratuity deductions only in limited cases. Before paying any part of gratuity to a third party, employers should check what they have already agreed to and obtain clear written consent from the employee.

If you are about to leave a job, take these steps first:

  • read your loan agreement carefully
  • ask the bank for an up to date statement
  • compare any frozen amount with the amount still owed
  • keep proof that you have been paying instalments on time
  • check your final settlement, including leave balance and gratuity

Key takeaway

A UAE bank may be able to use your gratuity to settle a personal loan, but only within the limits set by the loan agreement and banking rules. If more money is frozen than you owe, or if the bank has no proper contractual basis, you may have grounds to challenge it.

FAQ

Can a UAE bank take all of my gratuity for a personal loan?

It can use gratuity to recover a personal loan if the agreement allows it, according to the legal experts quoted by Gulf News. But it cannot freeze more than the amount you actually owe.

If I keep paying my instalments after resigning, can the bank still freeze my gratuity?

It may still freeze the account receiving the gratuity as a precaution. However, Ahmed Odeh said workers who continue paying on time may have a valid case to ask for the gratuity to be released.

Can a bank freeze gratuity for a home loan in the UAE?

According to Odeh, no. He said banks cannot freeze gratuity to repay a home loan.

Can my employer send my gratuity directly to the bank?

Only with care. Praise Olawanle said an employer has no obligation to do that unless it gave the bank a specific written undertaking, and paying without proper basis could trigger a complaint.

What should I do if the bank freezes too much of my gratuity?

Ask for a full loan statement and compare it with the frozen amount. If the bank has held more than you owe, you can object, complain to the bank, then escalate to Sanadak or the courts.
