In the bustling employment market of Dubai and the UAE, understanding the legal framework is crucial for both employers and employees. The introduction of Federal Decree Law No. 33 of 2021 on February 2, 2022, has brought significant changes, particularly in converting unlimited contracts to fixed-term ones. For those navigating this transition, knowledge of these legal standards is essential in safeguarding rights and ensuring fair treatment.

Many employees in Dubai find themselves faced with new contracts that starkly differ from their original agreements, often involving significant reductions in basic salary. This situation raises important legal questions: Are such changes permissible? And what rights do employees have should they choose not to accept these altered terms?

According to the UAE’s Current Employment Law, the transition from unlimited to limited-term employment contracts is mandated to align with the new legal framework. This conversion process was initially set to be completed by February 1, 2023, but has since been extended to December 31, 2023, allowing employers and employees more time to adjust.

Importantly, the law stipulates that any conversion or modification of employment contracts should not adversely affect the employee. Specifically, changes made to the terms of employment during this transition must be more advantageous to the employee, barring any imposition of reduced conditions such as a lower salary.

Should an employer attempt to enforce a contract that reduces the employee’s salary or otherwise diminishes their rights, such actions could be contested. Employees are not obligated to sign revised contracts that offer less favorable terms than their current agreements. Moreover, termination of employment under these circumstances could be deemed arbitrary, enabling affected employees to seek legal recourse. This includes filing complaints with the Ministry of Human Resources & Emiratisation and potentially seeking compensation through legal channels.

For employees in Dubai and the broader UAE finding themselves navigating these changes, understanding your rights under the Current Employment Law is paramount. No individual should feel compelled to accept reduced terms without consent, and the law provides mechanisms to challenge unjust modifications and terminations.

As Dubai continues to evolve as a dynamic hub for employment, staying informed about the legal landscape is key to ensuring fair and equitable treatment in the workplace. Whether you’re an employer or employee, understanding these legal provisions is crucial in navigating the contractual and salary-related changes within the UAE’s corporate environment.
