As a job seeker or employed individual in Dubai, understanding your medical leave entitlements is crucial, particularly when facing health challenges that necessitate extended absence from work. If you find yourself in a situation requiring long-term medical leave due to a mental illness or any other health condition, it’s essential to be aware of the legal framework that protects your rights.

Under the guidelines established by the Federal Decree-Law No. 33 of 2021, which governs employment relations in the UAE mainland, you gain certain medical leave benefits upon completing your probation period. As per Article 31(3) of this law, eligible employees are entitled to a total of 90 days of sick leave per year, which breaks down as follows:

  • The first 15 days include full salary coverage.
  • The subsequent 30 days provide half pay.
  • Any additional days are considered leave without pay.

Taking leave without pay beyond these 90 days is subject to obtaining approval from your employer, in line with Article 33(1) of the Employment Law. Notably, the nature of your illness does not alter your sick leave rights, as the law does not distinguish based on your specific health condition.

To legitimize your leave, it’s imperative to submit a medical report within three working days of your sickness to your employer, as stated in Article 31(1) of the Employment Law. If your illness requires more than the designated 90 days, you may discuss combining your sick leave with annual leave or requesting further unpaid leave with your company.

Bear in mind, should you be unable to resume work following the completion of your sick leave, your employer has the right to terminate your employment, preserving your entitlements in accordance with Article 31(5). This legal backdrop underscores the importance of clear communication and formal agreements with your employer regarding medical leave to safeguard your position and well-being.
